Most Frequent Questions and Answers About Potential Changes in DACA
Recent decisions pertaining to DACA may affect young people who today have Deferred Action Cases under the DACA program but also those who want to apply for the new program now. Given the confusion, this is creating in the community, this brief newsletter aims to provide answers to the most common questions that are coming to our office today. We hope this helps our readers.
- What news has recently been published affecting DACA program?
On November 15, 2020, a federal judge in Maryland ruled Chad Wolf, the Secretary of Homeland Security, was not legally serving as an interim secretary when he signed rules limiting applications and renewals for the DACA program. In addition, the Office of Government Responsibility issued a report in August saying that Wolf’s appointment was part of an invalid succession order.
2. What doesthis mean?
This means that the memorandum published by Mr. Wolf after the Supreme Court ruling on DACA establishing that new DACA applications would not be allowed and that work permit renewals and deferred action in existing cases would be reduced from two to one year is null and avoid.
3. So, can I submit my DACA application now if I qualify?
Not yet, It is advisable to wait a minimum until December for the publication of more guidance on this matter. The government may appeal the decision or even formally nominate Chad Wolf’s position as Secretary of Homeland Security before new President-elect Biden takes office in January 2021.
4. How can I prepare in the meantime?
Start collecting documents proving that you entered the country before the age of 16 and before June 2007. Look for evidence that shows that you were present on June 15, 2012. Also, if you did not graduate from high school, sign up now to take classes to graduate or to obtain the equivalent certificate.
